1. About these Terms

These Gift Card Terms & Conditions explain how Apoteca gift cards are purchased, delivered, activated, used, refunded, restricted, cancelled or replaced.

These Terms apply to Apoteca gift cards purchased or used through Apoteca.al, our website, online store, mobile applications, physical boutique, customer support channels or other sales channels operated by Apoteca.

These Terms form part of our Terms & Conditions and should be read together with our Privacy Policy, Returns, Refunds & Cancellation Policy, Loyalty Program Terms and any campaign-specific terms shown on the Platform.

By buying, receiving, using or attempting to redeem an Apoteca gift card, you agree to these Terms.

Nothing in these Terms limits your mandatory rights under Albanian law.

2. What an Apoteca gift card is

An Apoteca gift card is a closed-loop Apoteca-only voucher or code that can be used toward eligible purchases on Apoteca.

Gift cards are issued and redeemed in Albanian lek (ALL).

Gift cards can only be used with Apoteca. They cannot be used with other merchants, withdrawn as cash, transferred to a bank account, exchanged for cash, used as a payment account or used outside Apoteca, except where required by law.

An Apoteca gift card is not:

  • cash;
  • electronic money;
  • a bank account;
  • a payment account;
  • a deposit;
  • a financial product;
  • a general-purpose payment instrument;
  • a credit product;
  • a transferable money balance.

Gift cards are intended for personal consumer use only and may not be used for resale, wholesale, fraud, abuse, money laundering, unauthorized commercial activity or any unlawful purpose.

3. Buying a gift card

You may be able to buy an Apoteca gift card through the Platform, our physical boutique, customer support or another channel approved by Apoteca.

Available gift-card values, minimum amounts, maximum amounts, purchase limits, delivery methods and payment methods are shown at checkout or at the point of sale.

Apoteca may set or change:

  • minimum gift-card value;
  • maximum gift-card value;
  • purchase limits per order;
  • purchase limits per account;
  • redemption limits;
  • permitted payment methods;
  • available delivery methods;
  • fraud-prevention or verification requirements.

Gift cards may not always be available for purchase.

We may refuse or cancel a gift-card purchase where we reasonably suspect fraud, abuse, unauthorized payment, payment failure, incorrect information, system error, legal risk or breach of these Terms.

4. Delivery of gift cards

Gift cards may be delivered digitally, physically or through another method shown at checkout or confirmed by Apoteca.

Digital gift cards may be delivered by email, account message, QR code, claim link, gift-card code or another digital method.

Physical gift cards, if offered, may be delivered by courier, collected in store or provided through another method confirmed by Apoteca.

You are responsible for entering the correct recipient name, email address, phone number, delivery address and message, where applicable.

We are not responsible if a gift card is delivered to the wrong person because you entered incorrect or incomplete recipient details.

If you notice an error, contact us immediately at [email protected]. We will try to help where possible, but we cannot guarantee correction once a gift card has been issued, sent, viewed, claimed, activated or redeemed.

5. Activation and use

A gift card may need to be activated, issued, claimed or confirmed before use.

To use a gift card, you must enter the gift-card code, scan the QR code, apply the gift card in your account, or follow the redemption process shown by Apoteca.

Gift cards may be used toward eligible products and orders on Apoteca.

Gift cards may be used alone or together with another payment method, unless restrictions apply.

If the order value is lower than the gift-card balance, the remaining balance stays on the gift card or linked account balance for future eligible use.

If the order value is higher than the gift-card balance, you must pay the remaining amount using another accepted payment method.

6. Restrictions on use

Gift cards may not be usable for:

  • buying other gift cards;
  • buying store credit or similar value products;
  • cash withdrawals;
  • delivery fees, unless Apoteca allows this;
  • cash-on-delivery fees, if any;
  • excluded products;
  • certain campaigns or promotions;
  • wholesale, resale or business purchases;
  • suspicious, fraudulent or abusive orders;
  • orders blocked by payment, fraud, account or risk checks.

Apoteca may apply redemption limits, product exclusions, order-value limits, account checks or fraud-prevention controls.

We may refuse or delay redemption where we reasonably suspect fraud, abuse, unauthorized use, payment risk, stolen code, technical error or breach of these Terms.

7. No cash redemption

Gift cards and unused gift-card balances cannot be exchanged for cash, withdrawn, transferred to a bank account or refunded in cash, except where required by law.

Gift cards cannot be used as a general payment method outside Apoteca.

Gift cards cannot be sold, traded, transferred for value, used for unauthorized commercial activity or used in any way that breaches these Terms.

8. No expiry

Unless stated otherwise for a specific campaign or required by law, Apoteca gift cards do not expire.

The unused balance remains available until it is fully redeemed, cancelled, replaced, restricted because of fraud or abuse, or otherwise handled according to these Terms and applicable law.

If Apoteca decides to discontinue gift cards or materially change how they work, we will aim to provide reasonable notice and a reasonable way to redeem remaining valid balances, where required or appropriate.

9. Gift-card balance

You may be able to check your gift-card balance through your account, checkout, customer support or another method provided by Apoteca.

Gift-card balances are shown in ALL.

The balance shown may be delayed or temporarily inaccurate due to technical issues, payment checks, refunds, partial redemptions, synchronization delays or fraud-prevention checks.

Apoteca may correct a gift-card balance where there has been an error, fraud, abuse, refund, chargeback, failed payment, duplicate credit, technical problem or other issue.

10. Refunds for purchases made with gift cards

If you use a gift card to pay for an order and that order is later cancelled, returned, refunded or partially refunded, the refund will normally be returned to the same gift card, a replacement gift card, store credit or your Apoteca account balance, unless required otherwise by law.

Where an order was paid partly by gift card and partly by another payment method, Apoteca may refund each part back to the original method or equivalent balance, unless required otherwise by law.

Refunds are calculated based on the amount actually paid, taking into account discounts, promotions, loyalty points, store credit, gift cards, bundles, free gifts and other benefits.

Refunds and returns are handled according to our Returns, Refunds & Cancellation Policy and applicable law.

11. Cancelling a gift-card purchase

If you buy a gift card and wish to cancel the purchase, contact us as soon as possible at [email protected].

We may be able to cancel and refund a gift-card purchase if the gift card has not yet been:

  • issued;
  • sent;
  • delivered;
  • viewed;
  • claimed;
  • activated;
  • redeemed;
  • partially redeemed;
  • linked to an account;
  • used in any way.

Once a gift-card code has been issued, delivered, viewed, claimed, activated or redeemed, it is generally non-cancellable and non-refundable, except where required by law.

For digital gift cards, cancellation rights may be limited once digital delivery or immediate supply has begun, where permitted by law.

12. Incorrect recipient details

You are responsible for making sure recipient details are correct before buying or sending a gift card.

This includes:

  • recipient email address;
  • recipient phone number;
  • delivery address;
  • name;
  • message;
  • delivery date, where applicable.

If you enter incorrect recipient details, Apoteca is not responsible for loss, delay, delivery to the wrong person or unauthorized use, unless the issue was caused by Apoteca’s fault or another reason for which we are responsible under applicable law.

If a gift card has not yet been used, we may try to cancel and reissue it, but we do not guarantee that this will be possible.

13. Lost, stolen or shared gift cards

Treat gift-card codes like cash.

You are responsible for keeping gift-card codes, QR codes, claim links and account access secure.

Apoteca is not responsible for gift cards that are lost, stolen, copied, accessed, shared, used by another person or redeemed without permission, unless the issue was caused by Apoteca’s fault or another reason for which we are responsible under applicable law.

We may, at our discretion, replace a lost or stolen gift card only where:

  • you can prove purchase;
  • the gift card has not been redeemed;
  • the balance is still available;
  • we can verify the original gift card;
  • there is no suspected fraud or abuse.

Replacement is not guaranteed.

14. Fraud, abuse and misuse

You must not use gift cards for fraud, abuse, money laundering, unauthorized commercial activity, resale, automated activity or any unlawful purpose.

You must not:

  • buy gift cards with stolen or unauthorized payment methods;
  • use gift cards obtained through fraud, theft, deception or technical error;
  • resell gift cards without authorization;
  • use gift cards to abuse promotions or refunds;
  • use multiple accounts to exploit gift-card offers;
  • attempt to convert gift cards into cash where not permitted;
  • use bots, scripts or automated tools to buy, claim or redeem gift cards;
  • tamper with gift-card codes, QR codes, balances or redemption systems;
  • use gift cards for suspicious, high-risk or unlawful transactions.

Where we reasonably suspect fraud, abuse, error, unauthorized use or breach of these Terms, we may:

  • refuse to sell a gift card;
  • delay delivery;
  • require additional verification;
  • cancel a gift card;
  • freeze or restrict a gift-card balance;
  • refuse redemption;
  • reverse a transaction;
  • cancel or delay an order;
  • suspend or close an account;
  • report suspected fraud or abuse to payment providers, courier partners, service providers, legal advisers or authorities;
  • take other steps permitted by law.

15. Chargebacks and failed payments

If a gift card is purchased using a payment method that later fails, is reversed, refunded, charged back or identified as unauthorized, Apoteca may cancel or restrict the gift card and any related balance.

If the gift card has already been used, Apoteca may cancel or recover the value from related orders, accounts, refunds, balances or future transactions where permitted by law.

We may require additional payment or verification before allowing further use of the gift card or account.

16. Promotions involving gift cards

Gift-card promotions may have additional terms, such as minimum purchase values, maximum discounts, excluded products, limited redemption periods, non-transferability or campaign-specific rules.

Promotional gift cards, bonus cards, free cards, campaign cards or goodwill cards may have different rules from purchased gift cards.

Unless stated otherwise, promotional gift cards:

  • may not be exchanged for cash;
  • may be non-transferable;
  • may have an expiry date;
  • may be limited to certain products or campaigns;
  • may be cancelled if the qualifying purchase is returned or refunded;
  • may be cancelled if obtained through abuse, fraud, error or breach of campaign rules.

If there is a conflict between these Terms and campaign-specific terms, the campaign-specific terms apply to that campaign, unless this would breach applicable law.

17. Gift cards and loyalty points

Unless Apoteca states otherwise, gift-card purchases do not earn loyalty points.

Orders paid with gift cards may earn loyalty points only on eligible amounts actually paid, if permitted by the Loyalty Program Terms and shown on the Platform.

If an order paid with a gift card is returned or refunded, any loyalty points earned from that order may be cancelled, deducted, reversed or adjusted.

Gift cards may not always be combined with loyalty points, store credit, discount codes, free gifts, samples or other promotions.

18. Errors and corrections

If a gift card is issued, delivered, displayed, credited, redeemed or refunded incorrectly because of a technical error, pricing error, system error, human error, fraud, abuse, payment reversal or misuse, Apoteca may correct the error.

This may include:

  • correcting the gift-card balance;
  • cancelling a duplicate card;
  • reversing an incorrect credit;
  • cancelling an affected order;
  • requesting additional payment where value was wrongly used;
  • restricting the gift card or account while the issue is investigated;
  • issuing a replacement card where appropriate.

We may make corrections even after a gift-card balance appears in your account, where the balance was incorrect or obtained improperly.

19. Account deletion

If a gift card is linked to your Apoteca account and you request account deletion, you should use any remaining gift-card balance before your account is permanently deleted.

Account deletion is subject to the 30-day recovery period described in our Privacy Policy.

After account deletion, access to gift-card history, linked balances, claim records or redemption records may be lost, deleted, anonymized or retained only where legally required or justified.

Where legally and technically possible, we may allow a valid unredeemed gift card to continue to be used through its code, even if the account is deleted. However, we do not guarantee restoration of account-linked balances after permanent account deletion.

20. Availability and technical issues

We do not guarantee that gift-card features will always be available, uninterrupted, error-free or compatible with every device, account, payment method or sales channel.

Gift-card purchase, delivery, claim, balance-check or redemption may be delayed, unavailable or inaccurate due to technical issues, maintenance, fraud checks, payment checks, account checks, provider issues, synchronization delays or operational reasons.

We may temporarily suspend gift-card features to fix errors, prevent abuse, update systems, protect customers or protect the Platform.

21. Changes to these Terms

Apoteca may update these Gift Card Terms from time to time to reflect changes in our gift-card features, Platform, technology, providers, legal obligations, fraud-prevention practices or business operations.

The latest version will be published on the Platform with the “Last updated” date.

Where required by law or where changes are material, we may provide additional notice.

Changes do not remove mandatory rights that you have under applicable law.

22. Governing law

These Terms are governed by Albanian law.

Any disputes will be handled according to our Terms & Conditions, unless mandatory consumer-protection rules require otherwise.
